My boyfriend and I recieved an annoyomous complaint from someone in our condo that our "dog barks all day and night." We believe it is from our upstairs neighbor. Firstly, from the hours of 9 pm to 6 am our dog is sleeping and not barking. The only time he has barked is when she was up banging around and vacuuming at 3 am and when there was a loud party coming from our downstairs neighbor. Even this was very brief and one of two short barks. We are not there from about 6 am to 1 pm because of work. When I return home he has clearly just woken up and I don't hear a peep out of him. When my boyfriend cages him before he leaves for work he says that he immediately curls up and sleeps. The only time our dog barks during the day is when our upstairs neighbor loudly blares her tv, walks around (stomps around from what we hear), drops things, and repeatedly walks down the stairs as loud as possible. How do we fight this when the cause of our dog's barking is her??

Do you have a tape recorder? If so, would it be possible to leave it switched on during the day. That way you could prove your dog is, or is not, barking. I am sure in this technical age there must be some way of doing this. Good luck though. You are probably on a hiding to nothing!

Leave an anonymous complaint about her :] Talk to your other neighbors, see if they feel the same about your dog, if they don't, see if they feel the same about your noisy neighbor. If they do, have them complain too.

Ask for proof. Ask other neighbors if they've had problems with barking. If they answer no, get them to act as witnesses for you.

If all else fails, do an audio recording of the noise in your condo for a full day.

We had the same problem with our former upstairs neighbors. They would stand outside yelling, swearing and fighting with each other, and get our dogs upset. Of course, the dogs would bark. They complained to the landlord, but did NOT tell him they were the cause of it. We spoke to him about what was going on. You should go to the owner or manager of your condo and talk to them about it. If you feel it is your upstairs neighbor, then you should do a complaint on the things she is doing....not to be spiteful, but you have your rights too. She is causing a problem by what she is doing.

it sounds like your neibour is trying to get you kicked out by forcing your dog to bark, did you ever do something that might have upset her ?? you should talk to her about it and it she continues you should report her. i have a neibour that is the same way and we have to call the cops atleast once a week after a month of that she eventually stopped.

I had the same type of problems. Anti social neighbors taking something and blowing out of proportion. Document the facts in case animal control gets involve. Also if your other neighbors support you then you have some ammo to support yourself. The person needs to understand that when you live in close quarters like you all are you have to be tolerant of things. If she is unable to do it then she should move to the country. Confront the person and have a talk with them. Stand your ground and stand up for your rights but be prepared to make concessions if she has a valid argument. On my case animal control got involved but after a talk with them they investigated and found my neighbor to be full of%^^. Your nieghbor may also not know what nuisance barking is compared to reg barking. It is also in your best interest to try to limmit your dogs barking as much as possible just to keep the peace. Good luck we all live by as???les
