View Full Version : Do barking dog complaints usually win if they have to go to court?
Or are they usually thrown out by the judge? We have a new neigbor that just wont quiet her dog. I first talked to her and she was very defensive and called me a "psycho jerk" over the fence when I told her dogs to shut up. We next placed two letters on her door to no avail. I keeped the nasty letter she wrote back to us. My friendly neighbor says she is now going around the neiborhood telling lies about me that I am a mean person. We have animal control in charge of the case now with two letters sent to her. She still doesn't do anything. The dog doesn't bark all the time, only occasionally but wakes me up almost every morning which has forced me to sleep on the other side of the house. We have audio and video evidence to prove our case. Anything else I should do to end this?
Chances are its gonna be thrown out. Because there is nothing she can do about the barking. But the letters do stand a case.

go to court...I"m sure that when they slap her with enough fines, she'll find a resolution.........

would they be as tolerant if I revved up my car engine frequently during the day and NIGHT......or a skill saw???
Wonder how that would set with them?
I've tried ear plugs..they DON'T stay in my ears and they make my ears itch.......
why should I be the one to go to extremes when they are violating my peace and quiet?
Dogs don't understand inconsideration...but their owners do, and choose to ignore it. It's selfish and rude...
Take her to court with all the evidence you have accumulated. If there is a noise ordinance in your area, you will most likely win. Legal counsel would likely also help if you wanted to go after compensation (ie: pain and suffering, missed sleep, etc.). Good Luck!
PS: Husband and I have 2 dogs and we shut them up when they bark.
a dog is going to bark humans can not control it with out a muzzle tell your neighbor to put a muzzle on the dog at nights so u can enjoy your rest.
First and foremost I am a dog owner (and have been for 30 years), and an all around animal lover. Absolutely you can go to court and issue a summons on this "ignorant, rude and irresponsible neighbor". For all the people in this world who let their dogs incessively bark and do not give a s**t about their neighbors.....SHAME, SHAME ON THEM. I have had my entire family woken up at unacceptable hours from barking dogs that rude neighbors own. It IS possible to control a nuisance barking dog or dogs. It is up to the ill-mannered owners of these ill-mannered dogs not to be disruptive to their neighbors. We all have to deal with the daily noises of life, never mind sitting in our homes and being terrorized by barking dogs....NOT. Seeing as you have tried to reason with this idiot neighbor of yours....I would run, not walk to your local courthouse and have this settled. It does work, I know of someone who went through this and had it resolved.

It's a civil matter and you're doing all the right things, I know how you feel and this is a REAL legal issue, it won't be thrown out. You have the right to "quiet enjoyment" of your property.
I would also research noise ordinances, go to your city engineer's office or the county code department, some department has these written up. Read up on them and you'll see exactly what rights are being violated. I would also speak with neighbors in the area to see if any others are having the same problem and see if they'll help you.
The issue in civil cases is usually "the preponderance of evidence" in other words "whoever has the most evidence wins". So show up with as much to back up your claims as you can, and you should win. I don't know what the order will be but it should be some sort of solution. You shouldn't have to move because your neighbor is selfish, this is a rational concern and one a judge should understand and help with.

Notice BECKA and Meow and Ashton and perhaps others above are one of these obnoxious neighbors we've all had !!! lol. "it's not my fault, I can't help it...it's a dumb animal..." Imagine how she'll be as a mother! "I can't control him, he's got a mind of his own..."
She's wrong, you DON'T have the right to do things that infringe on the rights of others. If you want a noisy dog, you need to go buy a house in the country, it's your dog, it shouldn't become someone else's problem honey. Use your head, we all have rights (becka) not just you. Clearly the neighbor thinks like you do lol. Anyway, believe me, the judge will disagree with becka, only selfish people say "it is what it is, it cannot be helped" the judge will help you.
I don't know how she's supposed to stop her dog from barking - it's an animal, it can't help it. Unless she's doing something mean to the dog to make it bark you probably can't do anything. It sucks, but that's just how it works.

depends on the local ordinance. My city's ord. states that ANY barking is an offense, so when a neighbor called AC on us ofr our young dog barking I told him that that I heard anohter dog barking across town and that he had to investigate right away as I was filing a complaint. I couldn't be specific about the address as it was across town, but I was quite certain that some dog was barking somewhere on the other side of town and my claim of hearing it was all that is required under our poorly-written code.
I think you should relax. I mean if the dog is not barking for hours at time what is big deal. I have two dogs and they bark but only if something is bothering them like some one outside our house. Does the animal control think that the dog is being a loud dog. Is the dog barking before normal noise house. Like were I live everything should be quite between 8 am and 9 pm and on the weekends it is from 9 am to 11 pm. I think there are lot of factors about this case. If I was a judge I would hear out the case but put restriction such as times when noise was a loud such as listed about.

well i dont know how it works but as far as i knew legally you can make as much noise as you want during the daytime as long as its not over a certain amount of decibles(dog barks are quieter than the limit)...
shes very unfriendly, most people i know try and get their dogs to stop.
heres what id do, id record the barking, get a loud stereo, face it out my window towards her house and play the dog barking loud over her dog barking...

Why is this even going to court?
Go to the SHARPER IMAGE or some GADGET STORE and freaking buy a DOG QUIETER.
Problem solved.
