1. My dogs are not the one barking. (Reason: The times I am up is the time she says they are barking...early mornings. I am up from 4pm-8am everyday.) I do not permit my dogs to bark anytime before 8am. Is anytime after 8am still consider not permissible?

2. I live in a gated community and the HOA has sent a complaint. Do they have the authority to fine me and without proof?

3. I have put my dogs away for two weeks and still complaints from the same person when they weren't there. Can I file a harassment complaint now since they still have no proof?

I hate people like that! The neighbor who used to live in the apartment behind our house would blame the barking from a different neighbors smaller dogs on our two large dogs.

He would call the cops and our dogs would just be sitting there, wagging their tails. He even told the cops we had a wolf! We have a small husky!

When we confronted him, he said it was because we had no business owning big dogs in a city. And he said the small dogs were fine because they belong in a city.

Some people are just crazy. Definitely file a complaint, and if you have the spare money, talk to an attorney to see what the best way to go about protecting yourself would be.

if you can prove that you dog was NOT on site during the latest round of complaints then I think you would have a good cause to be able to lodge a harassment suit against the one making the complaints.

We had one neighbour that thought it was our dog barking but they was over one night and they heard the dog that they THOUGHT all along had been ours and as she was sitting at their feet asleep they could see it was not her..............

When I once complained about a barking dog, I had to give the police the address. The policeman parked on the street & listened to the dog barking himself. Therefore, he had the proof. It doesn't matter what time of the day or night your dogs bark; they are disturbing the peace. Think babies, various shifts and us elderly people who need our naps. And even if none of those are involved, how would you like to be home and listen to that?

Yes, the HOA can fine you. 10 to 1 they've heard your dogs bark. It's a community & people within a community are expected to be considerate of others in the community. My community also fines people who disturb others. Communities need rules to insure that this doesn't happen.

It's pretty easy to have "proof" when a person hears the dogs barking.
I'm just surprised they haven't involved the police; I know I would. There is even a separate listing for barking dogs. In my county the person is given a ticket for disturbing the peace and is given a hefty fine. Complaint #2 is even heftier and #3 you lose the dogs.

Re the harassment complaint - I wouldn't waste my money if I were you. The person who complained when the dogs were gone may have been following up on an earlier complaint. If you lose, you pay the court costs.
